Terms of Service

These Terms of Service (“Terms”) govern your use of Rate Me More. By accessing or using our service (as a business customer or end user), you agree to be bound by these Terms.

Users and Responsibilities: Users of Rate Me More include both business account holders (“Business Customers”) and end-customers who scan QR codes (“End Users”). Business Customers are responsible for their accounts and the content they upload. They must provide accurate information and comply with laws (e.g. data protection, advertising, anti-spam). They must not use the service for illegal activities or violate others’ rights. End Users (customers giving feedback) must use the feedback system honestly and not spam or abuse the platform. Business Customers users must keep login credentials secure and notify Rate Me More of any unauthorized use.

Plans and Limitations: Rate Me More offers different subscription plans. The Free Plan (no cost) provides basic features (e.g. single QR code, basic analytics). The Professional Plan ($29/month) unlocks more features (unlimited QR codes, advanced AI review generation, advanced analytics). The Lifetime Plan ($299 one-time) includes all Professional features plus extras (white-label, API access). Each plan has usage limits: for example, Free users may have limited analytics retention (30 days) and fewer monthly interactions; Professional users have higher quotas (analytics retained 90 days, more monthly interactions); Enterprise-level accounts have unlimited limits (365-day retention, unlimited API calls). If you exceed plan limits, your usage may be blocked or the system will prompt you to upgrade. Rate Me More may change plan features and pricing, but will notify you in advance.

API Use and Fair Use: We provide REST API endpoints for businesses on Professional or higher plans. API access is subject to rate limits (e.g. requests per month by plan). Clients must use the API ethically and not attempt to reverse-engineer or abuse the system. We enforce fair usage: excessive automated requests may result in throttling or suspension.

Payment and Subscriptions (via Stripe): All paid services are billed through Stripe. By subscribing, you authorize Stripe to charge your payment method for the selected plan fees on the chosen interval. Professional plans auto-renew monthly (or annually) until cancelled; Lifetime plans are one-time purchases. You can update or cancel your subscription via the Stripe Customer Portal or by contacting support. Cancellations stop future billing but do not refund past charges. We bill in USD (or local currency as specified), plus any applicable taxes. If a payment fails, we will notify you and attempt to retry; continued failure may lead to suspension of the account.

Account Suspension and Termination: We reserve the right to suspend or terminate accounts for violation of these Terms (e.g. illegal activity, payment failure, abuse) without notice. Upon termination, your access to business dashboards and data will cease. Business customers may request account deletion; personal data will then be removed according to our Data Retention Policy. We may preserve aggregate/anonymized data for reporting even after deletion of individual accounts.

Limitation of Liability: The Rate Me More service is provided “as is” without warranty. To the fullest extent allowed by law, we disclaim all guarantees of performance, accuracy, or availability. We are not liable for indirect, incidental, special or consequential damages (including lost profits or data) arising from use of the service. Our maximum liability for direct damages (if any) is limited to the fees paid by you in the three months before the claim. We do not control third-party platforms (e.g. Google, Yelp); we are not responsible for their policies or actions. We do not guarantee that AI-generated reviews will be accepted by third-party platforms.

Intellectual Property: All content on Rate Me More (including our branding, code, designs, documentation) is owned by Rate Me More or its licensors. You may not copy or use our intellectual property except as permitted. Business Customers retain ownership of their data (feedback, customer info, etc.), but grant Rate Me More a license to use it to provide services. Any reviews or analytics reports generated by Rate Me More remain property of Rate Me More (but you may use them for your business).

Governing Law: These Terms are governed by the laws of [Your State/Country], without regard to conflict of laws. Any disputes shall be resolved in the courts of [Your Jurisdiction] unless otherwise required. We comply with GDPR, CCPA, and other applicable data protection laws in our operations.

Changes: We may update these Terms at any time. Changes will be posted on our website with a revised effective date. Continued use of the service after changes constitutes acceptance of the new Terms.
